The named client on the document in most cases will need to sign this document TWICE:
- As the Settlor
- As their own Trustee
Any other nominated Trustee(s) will also sign
All signatures to be witnessed. . Please note that the witness must be over 18, must be deemed to have mental capacity and cannot be a settlor, trustee or beneficiary or be married to one of them.
IMPORTANT: The signing space for Countrywide should be left blank.
DECLARATION OF TRUST
Please sign on the last page of each deed. You will need to sign against your name. Your signature needs to be witnessed by an independent witness. Please note that the witness must be over 18, must be deemed to have mental capacity and cannot be a settlor, trustee or beneficiary or be married to one of them.
IMPORTANT: This document shouldn’t be dated anywhere.
MEMORANDUM OF WISHES
This is essentially the Letter of Wishes, which CAN be dated when signed – there will be one per client.
RX1 – LAND REGISTRY
Please sign ALL 3 copies in section 11 only (these forms do not need to be witnessed)
TR1 – LAND REGISTRY
Please sign in section 12 only – witness required for each client,. Your signature needs to be witnessed by an independent witness. Please note that the witness must be over 18, must be deemed to have mental capacity and cannot be a settlor, trustee or beneficiary or be married to one of them.
